The West Kensington and Gibbs Green tenants’ and residents’ associations have filed a claim with the High Court against LB Hammersmith & Fulham and RB Kensington & Chelsea over the handling of the Earls Court regeneration.
The action on multiple grounds claims first that the councils designated a planning document as a supplementary planning document, when, say the claimants, it should have been a development plan document.
It also claims that all the options assessed for the scheme breached strategic planning policy for failing to meet affordable housing targets, that the council breached equality rules, breached their own core strategy, as well as environmental assessment rules.
Last month, a group of traders won a similar action over the plans for Shepherds Bush Market. In that case the development has as yet been unaffected, as the application was not judged against the documents declared flawed.
